Invoice Terms and Conditions

1. Agreement to Terms By requesting or accepting services provided by Precision Plumbing Limited, the customer (“you”) agrees to be bound by the following terms and conditions.

2. Payment Terms

• 2.1 – Payment is due within 15 days of the invoice date unless otherwise agreed in writing. We reserve the right to charge interest on all overdue balances at 2% per month compounded until the date payment is received in full.

   

• 2.2 – Should you fail to make any payment due to us under any invoice, by the due date for payment, then without prejudice as to any other right or remedy available to us, we shall be entitled to:

   

  • 2.2.1 – Suspend any further works; and/or

     

  • 2.2.2 – Remove materials and/or labour and/or plant from site

     

• 2.3 – We accept payment via bank transfer, credit/debit card, or cheque. Please reference the invoice number when making payment.

   

3. Minimum Charge

Precision Plumbing Limited has a two-hour minimum charge for any works carried out.

4. Customer Responsibilities

• 4.1 – You (the customer) shall:

   

  • 4.1.1 – provide us and our employees, agents, consultants and subcontractors, with access to your premises, office accommodation and other facilities as reasonably required by us;

     

  • 4.1.2 – provide us with such information and materials as we may reasonably require in order to supply the services, and ensure that such information is accurate in all material respects;

     

  • 4.1.3 – prepare your premises for the supply of the services, ensuring that all furniture, fittings and flooring are protected sufficiently from dust and spillages prior to work commencing. There must be sufficient electrical outlets and a water supply

     

  • 4.1.4 – make good of any damage to the property required to complete the work. This can be organised by Precision Plumbing Limited, if requested in writing prior to works commencing;

     

  • 4.1.5 – obtain and maintain all necessary licenses, permissions and consents which may be required before the date on which the services are to start; and

     

  • 4.1.6 – keep and maintain all materials, equipment, documents and other property of ours (“Our Materials”) at your premises, in safe custody at its own risk, maintain our Materials in good condition until returned to us, and not dispose of or use the Materials, other than in accordance with our written instructions or authorisation.

     

5. Pre-Existing Issues

Precision Plumbing Limited will not be held liable for any pre-existing issues whilst carrying out works. Repairing or replacing any pre-existing issues will be charged as an extra, unless previously agreed in writing.

6. Call-Out Charges

• 6.1 – If work is conducted on a call out basis, you are deemed to have accepted these terms upon instructing us to complete the work requested.

   

• 6.2 – All call outs are subjected to a minimum fee of £90+VAT, which includes time spent assessing the issue, even if no further work is undertaken by us.

   

• 6.3 – Any work further to clause 6.2, completed by us, will be charged at a rate of £45 per hour + VAT for plumbing and heating matters, and £50 per hour + VAT for renewables installations and maintenance matters, these charges exclude the costs of any necessary materials and other disbursements which will be borne by you.

   

7. Title & Risk

• 7.1 – Risk in the materials and/or goods supplied to site shall pass to you when the materials and/or goods are delivered.

   

• 7.2 – The title in the materials and/or goods shall remain with us until you pay all sums due under any invoice or otherwise.

   

• 7.3 – Until title passes, you shall hold the materials and/or goods as fiduciary agent and bailee.

   

• 7.4 – We shall be entitled at any time to recover any or all of the materials in your possession, to which we have the title for and for that purpose we and our employees or agents, may with such transport as is necessary, enter upon the site where the work has been carried out.

   

8. Estimates and Variations

• 8.1 – Quoted estimates are subject to change in the event of unforeseen circumstances or if additional work is required. All variations will be discussed and approved prior to being carried out. A deposit will be required upon accepting any quotation or estimation. The deposit must be paid in full before ordering any materials or giving a start date to carry out works.

   

• 8.2 – The parties may at any time mutually agree upon and execute new work specifications. Any alterations in the scope of services to be provided under these terms of business shall be reflected in a separate fee quote and shall reflect any other terms agreed between the parties.

   

• 8.3 – Where Precision Plumbing Limited gives written notice to you, agreeing to perform any alterations on terms different to those already agreed between the parties, you shall, within 5 working days of receipt of such notice or such other period as may be agreed between the parties, advise the us by notice in writing whether or not it wishes the alterations to proceed.

   

9. Programme of Works

• 9.1 – We reserve the right to extend the time to carry out the works, without penalty, for any of the following reasons:

   

  • 9.1.1 – changes to the specification of the work agreed;

     

  • 9.1.2 – poor or bad weather;

     

  • 9.1.3 – delays caused by factors beyond our control; and

     

  • 9.1.4 – inability to secure labour or goods or materials

     

10. Cancellations

A minimum of 24 hours’ notice is required to cancel any scheduled appointment. Cancellations with less than 24 hours’ notice may incur a call-out charge pursuant to clause 6.

11. Warranty

All workmanship is covered by a 12-month guarantee. Manufacturer warranties apply to all parts and materials, subject to their terms and conditions.

12. Limitation of Liability

• 12.1 – Nothing in these terms and conditions shall limit or exclude our liability for:

   

  • 12.1.1 – death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors;

     

  • 12.1.2 – fraud or fraudulent misrepresentation; or

     

  • 12.1.3 – breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

     

• 12.2 – Subject to clause 12.1:

   

  • 12.2.1 – We shall, under no circumstances, be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the invoiced work; and

     

  • 12.2.2 – Our total liability to you in respect of all losses arising under or in connection with the invoiced work, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount of our quotation

     

12. Disputes

Any disputes or queries regarding these terms and conditions or any invoice must be submitted in writing within 7 days of the invoice date. Failure to do so will be considered acceptance of all charges.

13. Governing Law

These terms and conditions, all services and invoices are governed by the laws of the Isle of Man.

14. Jurisdiction

The Courts of the Isle of Man shall have exclusive jurisdiction to determine any dispute arising out of or in connection with these terms of business or any invoice.

Declaration

By engaging Precision Plumbing Limited for plumbing and heating services, the customer confirms acceptance of these terms and conditions.
